Regulations for Access / Loans

  1. GENERAL
 
    1.1 The Swiss National Sound Archives of Lugano collects, preserves, and documents the audio heritage of Switzerland. It makes available to users the collection of sound carriers, its database, and its collection of books, periodicals, and catalogs.
    1.2 The services offered by the Swiss National Sound Archives are available to anyone and consultation is free of charge.
    1.3 Limitations on the consultation of the holdings of the Swiss National Sound Archives may be imposed by archiving constraints.
    1.4 The user may consult the Swiss National Sound Archives database freely, through the Internet (www.fonoteca.ch website) or through a PC in the Swiss National Sound Archives users' room.
    1.5 The user, for his/her first visit, is invited to fix an appointment with the Secretariat of the Swiss National Sound Archives, which will inform him/her of the possibilities offered by the Swiss National Sound Archives and will complete a form with his/her personal data.
    1.6 The Swiss National Sound Archives may adopt suitable sanctions against users who do not respect the regulations.
    1.7 In cases of need, the Swiss National Sound Archives may introduce temporary exceptions to the regulations.

 

  2. CONSULTING THE HOLDINGS OF SOUND CARRIERS
 
   

As a rule, sound carriers may be consulted only in the users' room of the Swiss National Sound Archives or at the external listening stations located in other institutions (Libraries, Archives, University). Printed documents, attachments, etc., can be consulted only in the users' room of the Swiss National Sound Archives.

For consultation purposes, working copies, CD-R or MP3 (online), are used. To consult an original sound carrier, the consent of the Swiss National Sound Archives Management is required.

Special conditions applicable to the different holdings:

 
    2.1 Holdings of commercial sound carriers
      2.1.1 Commercial (i.e., commercially published) sound carriers may be consulted without any limitations of any kind, in the premises of the Swiss National Sound Archives or at the external listening stations.
      2.1.2 As a rule, for consultation purposes, a listening copy on a working carrier is used, or online consultation at one's own workplace is also possible.
      2.1.3 If no listening copy exists for consultation, it will be prepared by the Swiss National Sound Archives' Audio Technical Laboratory within one week.
      2.1.4 The listening copy is requested by the user using the "Request for sound carriers form.
      2.1.5 In case of damage, loss or theft of the listening copy, the user must also pay, in addition to the value of the damaged or lost carrier, an administrative charge of CHF 50.-- per carrier.
      2.1.6 The associated material (covers, texts or other attachments) may also be consulted in the premises of the Swiss National Sound Archives.
 
    2.2 Holdings of non commercial sound carriers
      2.2.1 Non commercial (i.e., not commercially published) sound carriers (forming part of the SUISA deposit, demo cassettes, deposits of private individuals, single recordings produced by the SSR or in the context of scientific research projects, etc.) may be consulted only with the permission of the owner (individual or corporate body) of the legal rights of the collection of materials in question. This permission, in written form, can be stipulated between the owner and the user or between the owner and the Swiss National Sound Archives.
      2.2.2 The owner may access his own collection for consultation without any limitations.
      2.2.3 As a rule, for consultation purposes, a listening copy on a working carrier is used, or online consultation at one's own workplace is also possible.
      2.2.4 If no listening copy exists for consultation, it will be prepared by the Swiss National Sound Archives Audio Technical Laboratory within one week.
      2.2.5 The listening copy is requested by the user using the "Request for sound carriers" form.
      2.2.6 In case of damage, loss or theft of the listening copy, the user must also pay, in addition to the value of the damaged or lost carrier, an administrative charge of CHF 50.-- per carrier.
      2.2.7 The associated material (covers, texts or other attachments) may also be consulted in the premises of the Swiss National Sound Archives.

 

  3. CONSULTATION OF THE LIBRARY
 
    3.1 Written documents may be consulted only in the premises of the Swiss National Sound Archives.
    3.2 Access to the library is free.
    3.3 The written documents deposited in the Swiss National Sound Archives archives (back numbers of periodicals, catalogs, etc.) must be requested from the staff.

 

  4. LOAN OF THE HOLDINGS OF SOUND CARRIERS
 
    4.1 Original sound carriers (commercial and non commercial) belonging to the Swiss National Sound Archives or deposited there are, as a rule, not available on loan. Exceptions must be authorized by the Swiss National Sound Archives' Management.
    4.2 Exceptions are made for loans to the owners of the holdings of materials deposited at the Swiss National Sound Archives. If the owner removes any original carriers from the premises of the Swiss National Sound Archives, he must sign a withdrawal receipt. For any use made of loaned materials, the Swiss National Sound Archives is discharged from any liability.

 

  5. LOAN OF WRITTEN DOCUMENTS
 
    The Swiss National Sound Archives Management may authorize, exceptionally, the loan of books or periodicals from its library.

 

  6. SERVICES PROVIDED ON PAYMENT ONLY
 
   

6.1

CARRIERS OF THE Swiss National Sound Archives holdings

Copies of carriers can be made for third parties only if they are no longer available on the market.

SUISA (Swiss Society for the copyright of authors of musical works) and IFPI (International Federation of Producers of Videograms and Phonograms, Switzerland) authorize the Swiss National Sound Archives, under a contractual agreement, to make copies of audio recordings stored in the Swiss National Sound Archives and protected by copyright, on condition that these copies are made for exclusively personal use (education, research, etc.). The applicant must sign a declaration in which he/she confirms that the copies received will be used exclusively for private purposes. Copies of sound carriers made for public or commercial use are subject to special regulations.

The Swiss National Sound Archives proceeds with the copying on a non professional carrier (CD-R or compressed MP3 file).

The Swiss National Sound Archives will invoice the material and the copying work and will add an all-inclusive charge of 20% + VAT for copyright, which it will credit to SUISA (see price list).

 
   

6.2

COPIES ON PROFESSIONAL CARRIERS

Subject to the limitations and rules explained in the preceding paragraphs, the Swiss National Sound Archives may produce working copies on professional (digital) carriers. The user will issue, on delivery of the material, a written declaration in which he/she undertakes to comply with the rules of the copyright declaration, notifying SUISA of any public use made of the copy (reproduction in public, broadcasts, shows, events, etc.).
The Swiss National Sound Archives is discharged from any obligation in relation to the aforesaid rights.

 

  7. OPENING HOURS
 
   

The Swiss National Sound Archives is open from Monday to Friday, from 10-12 and from 14-17. It is closed on the public holidays of the Canton of Ticino.

For the use of the remote listening stations, the opening hours of the host institutions are applicable.
