GENERAL

1.1 The Swiss National Sound Archives (FN) collects, preserves, and documents the sound heritage of Switzerland. It offers its users:
  • The documentation of the holdings of sound carriers, through its online catalog
  • Listening to collections of sound recordings in public, protected Listening points, located in other institutions (libraries, archives, universities).
  • The holdings of books, magazines, and printed catalogs, through its online catalog, for reading at the library.
1.2 The services offered by the FN are accessible to everyone, the consultation is free.
1.3 Access limitations to collections of the FN may be imposed by archival needs, or for granting protection of personal data.
1.4 The users can freely consult the database of the FN, via the Internet (website of the FN), via a PC in the listening room at the FN, and at the remote Listening points.
1.5 A user is invited, for his first visit, to make an appointment with the Secretariat of the FN. The Secretariat will inform the user about the possibilities offered by the FN, and will fill out a form with the user's personal data.
1.6 The FN may decide appropriate sanctions against users who do not comply with the regulations.
1.7 In case of necessity, the FN may introduce temporary exceptions to the regulations.

CONSULTATION OF THE HOLDINGS OF SOUND CARRIERS

As a rule of thumb, sound recordings can be consulted at the Listening points (with the exception of public access documents, which can be listened to "at home"). In addition, consultation is available in the listening room at the FN. Printed documents, attachments, etc.. may be consulted in the listening room at the FN only.

2.2.1 Non-commercial sound recordings (part of the SUISA demo tapes deposit, deposits of individuals, unique recordings produced by the SSR or of scientific research, etc.) are available only by permission of the holder (legal or natural person) of the legal rights of the collection. The authorization and the form of consultation shall be regulated, in writing, between the owner and the user, or have already been agreed for between the owner and the FN.
2.2.2 The owner can access the consultation of its collection without limitations.
2.2.3 The consultation takes place wherever appropriate, at the Listening points, at the premises of the Phonotheque, or by the mean a copy for private use.

PAID SERVICES

    6.1 Copying for private use

Copies may be produced, on payment, to third parties only if the carriers are no longer traceable on the market.

SUISA (Swiss Society for Rights of Authors of musical works), IFPI (International Federation of Producers of Phonograms and Videograms, Switzerland), and SIG (Swiss Association of Interpreters) empower the FN, with a contractual agreement, to produce copies of sound recordings stored in the vaults of the FN, and protected by copyright, provided that these copies are intended exclusively for private use (scientific, educational). The applicant shall sign a statement confirming that the copies received will be exclusively for private use.

The FN proceeds, on payment, to copying for private use onto a non-professional carrier (cd-r, mp3 compressed files, Audio-CD).
Copies of sound recordings intended for public or commercial use are subject to special regulations.

    6.2 Professional copying

Having understood all restrictions and rules of the preceding paragraphs, by the approval of the management, who will review each request, the FN may produce, on payment, professional copies. Upon delivery of the materials, the user will release a written statement in which he agrees to comply with the rules of the declaration of copyright, announcing to the SUISA any public usage of the copy (play in public, radio broadcasts, performances, demonstrations, remastering, etc.). The FN is released from any obligations in respect of these rights.
